Scholarship Students Working for TUBITAK-SANTEZ Projects to be Included in the scope of SSI

The Law Numbered 6676 on the Amendment to the Law on Supporting Research and Development Activities and Other Laws was published in Official Gazette No 29636 on February 26, 2016 and entered into force in March, 2016.
In this context the new law:

1-) provided private insurance possibility to scholarship students working for projects supported by state institutions and organizations by adding a specific remark “scholarship students working for projects supported by state institutions and organizations” to the expression “students who subject to compulsory internship” under item (b) of first paragraph of article 5 of Law Numbered 5510 on Social Insurance and Universal Health Insurance.
2-) determined the date of beginning of insurance on the day scholarship students join the project by rephrasing “vocational education or compulsory internship” to “vocational education, compulsory internship or as a scholarship student to perform duties” under item (a) of first paragraph of article 7 of Law Numbered 5510.
3-) took into consideration the scholarship total paid to the scholarship students as income on a premium basis by rephrasing the expression “vocational education or compulsory internship” to “vocational education, compulsory internship or as a scholarship student to perform duties” under item (k) of first paragraph of article 80 of Law Numbered 5510.
4) stated the obligation to provide occupational disease and accidents insurance to scholarship students working for projects by adding the expression “for scholarship students working for projects supported by state institutions and organizations, private institutions and universities” to “the schools in which such students receive education” under item (e) of first paragraph of 87 article of Law Numbered 5510.
With regard to the new regulation to be implemented by university and other organizations, scholarship students who do not apply for Social Security Insurance will not receive any payment.
In order to benefit from the new regulations the Academic Members in charge of the Projects supported by state institutions and organizations (TUBİTAK, SANTEZ) have to fill in the attached Scholarship Student SSI (SGK) form and submit it to the Unit for Scientific Research Projects enclosing a copy of the student’s ID card by the end of the working day on Tuesday, March 22, 2016. The forms for scholarship students to join the current projects or projects to be launched in the future must be submitted at the latest 3 (three) days prior to the start of scholarship.
In addition, it is necessary to submit Scholarship Student Information Sheet to the Unit for Scientific Research Projects by the 5th day of every month in order to follow the payments on a regular basis. No payment will be made in case the Scholarship Student Information Sheet is not submitted by the 5th day of every month. Any alterations in the status of a scholarship student due to either family insurance or SSI with other working place must be reported to the Unit for Scientific Research Projects within 1 (one) day. The information about a scholarship student resigning from the project must be submitted to the Unit for Scientific Research Projects within the latest 2 (two) working days.

In accordance with the applicable Law provisions scholarship students will not profit from the payment in case the relevant information is not submitted within the scheduled periods of time. Moreover, it is of high importance to make the relevant notifications within with the scheduled periods of time not to be subjected to SSI administrative fine.
